Consent to the Processing of Users' Personal Data

Terms:
1.1. Operator – Public Foundation “HOPE” – Help Others Pursue Education, located at: Republic of Kazakhstan, Almaty, BIN 250440026890;
1.2. Electronic Resource – the Operator’s websites on the Internet, including their versions for mobile devices and other multimedia devices (hereinafter referred to as the Electronic Resource or the Website);
1.3. User – any individual who visits the Operator’s Electronic Resource and/or provides their personal data to the Operator in order to use the functionality of the Electronic Resource.

Consent Text:

1. A user who uses the Electronic Resource and/or submits any information through its services (such as subscribing to newsletters and other mailings, sending messages, or using other methods), by doing so (including by entering and submitting personal information), confirms that they have voluntarily decided to provide their personal data and gives their full consent, in accordance with the Law of the Republic of Kazakhstan No. 94-V “On Personal Data and  Its Protection,” to the mixed processing, collection, use, storage, clarification (updating, changing), depersonalization, blocking, and destruction of their personal data, consent to the processing of personal data entered in the forms provided for filling out, as well as other data that can be technically transmitted to the Operator via the Internet.
The User gives consent to the processing of personal data freely, voluntarily, and in their own interest, in accordance with this Consent and the Personal Data Security Policy regarding the collection, processing, and protection of personal data of the Public Foundation “HOPE – Help Others Pursue Education” (hereinafter referred to as the Policy), which is available at: https://hopeworldcongress.com/
The User agrees that the processing may be carried out both by automated means and without the use of automation tools.
2. The User guarantees the accuracy of the personal data provided when using the Electronic Resource, confirms that the personal data belong to them, and bears full responsibility in the event of providing false data or data belonging to third parties.
3. In the event that third parties submit any claims to the Operator of the Electronic Resource regarding the processing or use of their personal data provided by the User, the User undertakes to settle such claims with the third parties at their own expense and on their own behalf.
4. The Operator of the Electronic Resource reserves the right to refuse the User access to the services of the Electronic Resource without providing any explanation for the refusal. In such cases, the User’s personal data shall be deleted if they are stored by the Owner of the Electronic Resource.
5. The Operator of the Electronic Resource has the right to use the User’s personal data within the limits permitted by the legislation of the Republic of Kazakhstan. The Operator also has the right to disclose personal data based on the provisions of federal legislation, including upon request from law enforcement agencies.
6. This Consent may be revoked by the User in writing. The Consent remains effective until the date of its withdrawal by the User, which is done by sending a statement of such withdrawal to the Operator of the Electronic Resource at the address specified in the Policy. The withdrawal becomes effective upon receipt by the Operator of the Electronic Resource.
7. The User is deemed to have read the Policy and to have given their Consent from the moment of first use of the Electronic Resource and hereby confirms that they are acquainted with the requirements of the Law of the Republic of Kazakhstan No. 94-V “On Personal Data and Its Protection,” and fully understands their rights and obligations concerning the protection of personal data.
8. The contact details of the Operator of the Electronic Resource are provided in the “Contacts” section.
9. By visiting the Electronic Resource, the User consents to the Operator’s use of cookies, web beacons, and mobile device identifiers in accordance with the terms of the Policy, allowing the Operator to use cookies each time the User visits the Electronic Resource.
10. If the User is a parent or guardian and becomes aware that their minor children have provided their personal data to the Operator without the User’s consent, the User should contact the Operator. The Electronic Resource prohibits the submission of personal data of minors without the consent of their legal representatives.
11. Personal data and personal information provided through the Electronic Resource will be used for the purposes specified in this Consent and the Policy. The duration of personal data processing (for each purpose specified in this Consent) shall be until the purpose of personal data processing is achieved.
Categories of personal data for which the User provides consent to processing include: surname, first name, patronymic; email address; phone number; information collected through metric programs; and other categories listed in this Consent and the Policy.
The information obtained may be used, among other things, for the following purposes:
11.1. Administration of the Electronic Resource and its activities;
11.2. Processing of messages, letters, and other materials sent by you (if any);
11.3. Sending informational messages (including the Electronic Resource’s feed) by subscription (if any);
11.4. Personalization of our Electronic Resource for you, including through the display of advertising content;
11.5. Providing you with the ability to use the services available on our Electronic Resource (if any);
11.6. Delivery of services purchased through our Electronic Resource (if any);
11.7. Sending you commercial messages (if any);
11.8.  Sending you email notifications that you have specifically requested (if any);
11.9. Sending informational email newsletters (you may unsubscribe at any time) – if any;
11.10. Sending you advertising messages that we believe may be of interest to you, through the display of advertisements on the website or via email or similar technology (you may notify us at any time if you no longer wish to receive marketing messages by email);
11.11. Providing third parties with statistical information about our users (however, these third parties will not be able to identify any individual user from this information);
11.12. Handling requests and complaints made by or about you related to our Electronic Resource (if any);
11.13.  Ensuring the security of our Electronic Resource and preventing fraud;
11.14. Monitoring compliance with the terms and conditions governing the use of our Electronic Resource;
11.15. Communicating with visitors of the Electronic Resource (if any);
11.18.  Other purposes reflected in the Policy.
12. If the User provides personal information for publication on the Operator’s Electronic Resource (such as submitting informational materials for placement on electronic resources, photographs, stories, news, and other materials), the Operator has the right to publish and otherwise use this information in accordance with the requirements of the Civil Code of the Republic of Kazakhstan on the basis of a non-exclusive license (unless otherwise provided by agreement), as well as in accordance with the rights granted to mass media by applicable law.
13. The Operator may disclose the User’s personal information and personal data:
13.1. To the extent required by the legislation of the Republic of Kazakhstan;
13.2. In connection with any ongoing or anticipated legal proceedings within the limits established by law, as well as in response to requests from authorized governmental and law enforcement agencies;
13.3. For the purpose of establishing, exercising, or defending the legitimate rights and interests of the Operator (including providing information to other parties for the prevention of fraud and reduction of credit risk) within the limits established by law;
13.4.  To analytical systems and advertisers for the purposes, scope, and limits set forth in this Consent and the Policy;
13.5. In other cases provided for by the legislation of the Republic of Kazakhstan.
14. Personal data and personal information that the User submits for publication on the Electronic Resources or provides for publication on the Electronic Resource may be accessible worldwide via the Internet. The Operator cannot prevent the use or misuse of such information by third parties.
15. The Operator shall not be liable for unauthorized disclosure of personal data in cases where:
15.1. It occurred as a result of the User’s negligence, such as using a weak or easily guessable password for their account or making the password available to third parties;
15.2. The Operator took all measures within its power to protect personal data, but unauthorized access to personal data occurred due to unlawful actions of third parties (hacking, attacks) or software vulnerabilities;
15.3. In all other cases, the liability of the parties shall arise in accordance with the applicable legislation of the Republic of Kazakhstan.
15. The User expressly agrees to the transfer of personal data and personal information as described in this Consent and the Policy.
16. The retention period for personal data and other personal information shall be until the purpose of personal data processing is achieved.
17.  The Operator takes reasonable technical and organizational precautions to prevent loss, misuse, or alteration of personal data and personal information as described in the Policy.
18. By submitting their personal data, the User acknowledges and understands that transmission of information over the Internet is inherently insecure, and the Operator cannot provide greater guarantees of security for data transmitted via the Internet than those described in the Policy.
19. The Electronic Resource contains hyperlinks and information about third-party websites. The Operator does not control and is not responsible for the personal data processing policies and practices of third parties when visiting their websites.
 
This document, in accordance with clause 1 of Article 389 and clause 5 of Article 395 of the Civil Code of the Republic of Kazakhstan, constitutes a public offer and a contract of adhesion.
